1)            JOHN SPINA:                Appeal #753 for a Variance to right setback of proposed addition 12.8’.  Request variance of 17.2’.  This is a continuation of a public hearing held on January 3, and January 24, 2005.  (Located 60 Ridge Road, Garrison) in an R-80 District.  TM #83.18-1-37 

 

2)                MATTHEW A. NOVRELLO on behalf of Joseph Tuana:                Appeal #761 for a Variance.  Property was subdivided by Deed by prior owner with the review and approval of the Building Department.  No one noticed that the side yard setback for the studio was less than Code.  Currently the current lot and neighboring lots cannot be reconfigured to avoid the need for other variances.  (Located 996 Old Albany Post Road, Garrison) in an R-80 District.  TM #50-2-50.2 

 

3)                MARYANN ALBANESE:                Appeal #754 for Variances:  Shed #1: front setback 24.5’, variance of 14.5’; left setback .3’, variance of 29.7’.  Shed #2:  front setback 39’, variance of 1’; left setback .4’, variance of 29.6’.  Addition:  left setback 1.8’, variance of 28.2’.  (Located 24 Hudson River Lane, Garrison) in an R-80 District.  TM #89.7-1-10. 

 

4)            PAULA CLAIR:                Appeal #755 for a Variance of 12’ on the right side for a deck that was built by previous owner.  (Located 162 Gallows Hill Road, Garrison) in an R-20 District.  TM #91.5-3-72. 

 

5)            RENEE DEVITO:                 Appeal #763 for a Variance for an existing front screened-in-porch that was built before 1974 and does not  meet building property setbacks from road.  The porch does not protrude beyond pre 1948 structure.  (Located 3 Winston Lane, Garrison) in an R-40 District.  TM #83.17-1-7.

7)            LAURIE BROWN and MARK MAZZYE:                Appeal #756 for a Variance for insufficient front setback of a structurally sound and unimposing deck.  The deck in question was already built when applicants purchased the home in 1999.  (Located 25 Winston Lane, Garrison) in an R-40 District.  TM # 90.8-2-30.  REVIEW FOR COMPLETENESS

 

8)            PAUL J. KAYE and CATHY DUKE:                Appeal #760 for a Variance.  Due to the irregular lot shape and contours, the existing house already overlaps the corner setback.  The proposed addition adds needed living space while drawing the structure away from the closest neighboring house.  The front setback variance is required in order to provide a covered entrance and much needed kitchen space.  (Located 21 Mountain Drive, Cold Spring) in an R-20 District.  TM #16.11-1-42, 43 & 44  REVIEW DRAFT RESOLUTION 

 

9)            JOHN PIELMEIER, IRENE O’GARDEN and KAREN SOUTHARD:                Appeal #758 for an Interpretation.  Applicants request to revoke and nullify permit issued for a commercial structure that permittee intends and has been told he is permitted to use for commercial purposes which are not permitted in the R-80 District.  (Located 5 Fox Glove Lane, Garrison) in an R-80 District.  TM #60.-2-37    DISCUSSION

 

10)          JOHN and LANI LEUTHNER:                Appeal #757 for a Variance.  Because property is long and narrow applicants could not meet requirements of front yard setback of 40 feet for a shed.  (Located 188 Old West Point Road – East, Garrison) in an R-40 District.  TM #82.8-1-36  REVIEW DRAFT RESOLUTION

 

11)                TIMOTHY J. and MARY C. DONOVAN:                Appeal #759 for a Variance.  Applicants request a 20-inch variance on the western property line.  The dining room addition has an 18’4” setback from property line which requires a 20-inch variance.  This variance request is highlighted by the fact that the pre-existing main section of the home is only 6’2” from this property line.  (Located 362 Old West Point Road, Garrison) in an R-40 District.   TM #71.-2-42  REVIEW DRAFT ESOLUTION

 

12)          JAMES M. COPELAND dba Hudson Design:                Appeal #764 for a Special Use Permit.  The owners of the Walter Hoving Home, Inc., would like to modify their existing facilities to create the following:  1) more room for recreational and educational functions 2) a modern food service facility and 3) additional staff housing.  (Located 10 Walter Hoving Home Road, Garrison) in an R-80 District.  TM #60-2-24  REVIEW FOR COMPLETENESS

14)          GUY MORRIS and PAMELA LIPPEE:                Appeal #765 for a Variance.  Applicants wish to subdivide the parcel into two lots.  Proposed Lot A does not meet the requirements of Section 175.30(B)(4) which requires 6,000 square feet of land on a building lot that is free of environmentally sensitive lands which is accessible without crossing a Class III slope.  (Located 6-8 High Road, Cold Spring) in an R-40/R-120 District.  TM #17.-2-30.3  REVIEW FOR COMPLETENESS
