PROPOSED LOCAL LAW

Section 175-54 Revisions and Extensions

 

 

 

 

 

A Local Law to amend the Code of the Town of Philipstown, Chapter 175 thereof entitled Zoning, to change Section 175-54 entitled Revisions and Extensions.

 

SECTION 1.  Chapter 175 of the Code of the Town of Philipstown is hereby amended to the extent that the following section shall now read as follows:

 

            SECTION 175-54. Revisions and extensions.

 

A.     Any revision of an approved special use permit application and any reconstruction, enlargement, extension, moving or structural alteration of an approved special permit use or any building, structure or facility in connection therewith shall require submission of a special use permit application as for the original application.

 

B.     Notwithstanding subsection A. above, schools, colleges, universities, general hospitals, cemeteries and educational, religious, philanthropic, scientific, literary, historical, agricultural, fine arts and charitable institutions may be issued a building permit by the Zoning Administrative Officer without a new special use permit application if the proposed building or structure meets all of the following criteria.

 

(1)    It is either (a) less than 1,000 square feet in size, or  (b) It replaces an existing building or structure less than 1,000 square feet in size of the same general function that has not been abandoned for a period of 2 or more years.

 

(2)    It does not add to the housing capacity of the institution.

 

(3)    It does not require the construction of new roads or parking facilities.

 

(4)    It does not generate additional traffic entering or exiting the institution.

 

(5)    It does not require new wastewater facilities or water supply wells.

 

(6)    It is not within 150 feet of any street or property line.

 

(7)    It conforms with all applicable bulk, use and other requirements of the district.

 

(8)    It is not sited on environmentally sensitive lands as defined in section 85-3 of the Philipstown Code.

 

(9)    It does not add any new exterior lighting unless required by Federal or State Law, Code, Rule or Regulation.

 

A statement addressing compliance with the foregoing criteria shall be submitted to the Zoning Administrative Officer with the building permit application.  If in the discretion of the Zoning Administrative Officer any of the above criteria are no met or are in question, the application shall be referred to the appropriate Board and shall require submission of a special application as for the original application.

 

SECTION 2.  Effective Date.  This Local Law shall become effective immediately upon its filing with the Secretary of State.
