CONSERVATION ADVISORY COUNCIL MINUTES

The regular meeting of the Town of Philipstown Conservation advisory Council was held on the above date at the Philipstown Town Hall, 238 Main Street, Cold Spring, New York.  The meeting was called to order by Acting Chairperson Andrew Galler at 7:30 PM.

 

 

Applicant:  Goldberg

Representative: Jason Snyder

Tax Lot: 1.-3-10

Permitting Authority: Wetlands Inspector

 

Acting Chairperson Andrew Galler asked Ms. Goldberg’s representative Jason Snyder to present the application.

 

Mr. Snyder:

·        Noted the property’s location on East Mountain Road South.

·        Said it was part of several Goldberg-owned subdivisions.

·        The Tomizawa and the Mackin properties were neighbors.

·        The house-construction entailed crossing a stream/intermittent stream with a driveway and a gravity-effluent sewer line.

·        Noted that the applicant had Health Department approval for a septic area, which is located 100 feet from the stream bed; i.e., that the septic is outside wetlands buffer.

·        The house had not yet been precisely located.

 

Wetlands Inspector Klotzle said that the house location needed to be staked out for a site visit, and that the proposed housing location had initially been in the stream buffer.

 

Mr. Snyder said that:

 

 

CAC member Lew Kingsley noted that the proposed septic field is 550 feet from the house, which means that a pipe will have to cross the intermittent stream.

 

Jason Snyder explained that the pipe – 4-inch, SDR-35 PVC -- would pass just over the culvert and would follow the driveway..

 

Acting CAC Chairperson Andrew Galler asked whether any CAC members had additional comments and whether a site visit should be made.

 

CAC member John Sussmeier said he thought a site visit was warranted.

 

CAC Member Lew Kingsley agreed.

 

Acting CAC Chairperson Galler said he would like the edge of  the septic to be staked.

 

Wetlands Inspector Klotzle noted that he had looked at the site, but before any staking had been done.

 

Jason Snyder said he would notify the CAC Secretary as soon as all the staking had been completed so that CAC members could be notified and a site visit arranged.

Tax Lot: 16.-1.16

Representatives: None

Permitting Authority: Wetlands Inspector

 

Wetlands Inspector Klotzle said that he had told the Schroeders that additional information was required (i.e., a topo) before their application could be considered.

 

CAC member Kingsley, noting the steepness of the site’s location, agreed.

 

 

 

 

Applicant: Tyjan Corporation

Tax Lot: 49.4-22

Representatives: None

Permitting Authority:

 

Wetlands Inspector Klotzle noted that no Tyjan representative was present and that hew did not know why.

 

Acting CAC Chairperson Galler noted that the application involved construction of a garage.

 

Andrew Galler said he believed the owner’s business was rebuilding used diesel equipment and that he had seen a lot of diesel equipment on the site.

 

Wetlands Inspector Klotzle said that, based on a discussion with the Building Department, a run-off structure the property’s south side was located near a wetland.

 

CAC Member Lew Kingsley noted that power washing was required before diesel equipment could be worked on, which also would create a runoff issue.

 

Acting CAC Chairperson Andrew Galler said that the matter would need to be considered at the next month’s meeting.

Permitting Authority: Wetlands Inspector

 

Wetlands Inspector Klotzle said that he had been informed that Mrs. Kim was in China and that therefore, pending her return, the Building Department’s request to fast-track her application – made because of the fire that had destroyed the dry cleaning enterprise on the site, which was her means of support – had been withdrawn pending her return.

 

 

Applicant: American Tower

Tax Lot: 60.18-1-3

Representatives: None

Permitting Authority:  Planning Board

 

Acting CAC Chairperson Andrew Galler noted that he had drafted a memo to the Planning Board covering both proposed sites (Upper Station Road and Albany Post Road) which he would distribute to the CAC for discussion.

Tax Lot: 27.-8-1-4

Representatives: None

Permitting Authority: Wetlands Inspector

 

Wetlands Inspector Klotzle said that their application is still pending and that he had reminded  him he needed to appear soon.
